Proceedings challenging AG’s decision not to prosecute Pilatus officials to resume in public

A case requesting a judicial review of the Attorney General’s order not to prosecute top Pilatus Bank officials will continue in public

Judge Doreen Clarke revoked a previous order for civil society group Repubblika’s case to be heard behind closed doors.

In November 2021, Judge Christian Falzon Scerri ordered lawyers and parties present not to reveal what was said in court.

This decision was reasoned with ongoing proceedings before the World Bank’s International Center for Settlement of Investment Disputes (ICSID).

Judge Doreen Clarke ruled that there was no evidence of an obligation of secrecy to justify continued hearings behind closed doors.

Repubblika requested the judicial review after it emerged that the Attorney General had ordered not to prosecute Pilatus Bank’s top brass.
