Government ‘wins’ Steward emergency arbitration

Steward ‘ordered to bear government’s costs’

In a statement on Friday, the government said it had “defeated” an emergency arbitration proceeding brought by Steward Malta Ltd, Steward Malta Management Ltd and Steward Malta Assets Ltd.

The International Chamber of Commerce Emergency Arbitration has ordered Steward Health Care to bear the Maltese government’s costs.

No further information on the matter was given in the brief government statement.

One day earlier, Steward announced it had filed a complaint against the Maltese government and judiciary with the European Commission.

In a reaction on Friday evening, Steward Health Care Malta blamed the media for “deliberate and misleading omission of facts”.

The company referred to reporting that the government sent a termination letter to the company and then stepped in to run the concession.

Steward said it submitted a termination notice to the government due to “non-rectifiable defaults on the government’s part” on 16 March.

“Today’s reporting further proves why SHCM felt unable to continue to operate in Malta, where institutions are clearly aligned against foreign investors”, it said.
